What you buy

A Vistward Pro licence is a personal, non-exclusive right to use the application with its Pro features, for one person, on at most three computers. It covers the major version current at purchase (for example 1.x) and all its updates. The Pro features are described on the pricing page; they arrive release after release, and the progress of each application is published on the website.

The free edition stays free. A new major version runs as the free edition until the licence is upgraded; the covered version stays usable with its Pro features.

The licence is bought once: it is not a subscription and does not expire.

Prices

Prices are shown in euros including VAT on the pricing page, lower per licence for larger orders. The amount paid is the price shown; the invoice states the VAT of the country of the billing address, and a business in the European Union that gives a valid VAT number is invoiced under the reverse charge. The upgrade of a licence to the next major version is sold at the price shown on the pricing page at the time of purchase.

Order and payment

Orders are placed from a Vistward account. Payment takes place on the secure page of Stripe, our payment provider, with the methods it offers. The order is final when the payment is confirmed. An invoice is issued for each purchase and stays available in your account.

Delivery

Licence keys are emailed and shown in your account as soon as the payment is confirmed, usually within seconds. For a payment method confirmed later, they are delivered on confirmation.

Right of withdrawal

A consumer normally has fourteen days to withdraw from a distance purchase. For digital content supplied at once, this right can no longer be exercised once supply has begun with their prior express consent and their acknowledgement that they lose this right (EU Directive 2011/83, article 16; French Consumer Code, article L221-28).

At payment, you ask for your key to be delivered at once and acknowledge that you thereby lose your right of withdrawal; the confirmation email restates this. A purchase made for a business has no right of withdrawal.

Giving out licences

The buyer gives each licence to a person by their email address from their account; that person receives the key and finds the licence in their own account. The buyer may give a licence to someone else at any time: it then gets a new key and the computers using it are removed.

Activation and computers

A licence is activated by entering its key in the application, which then contacts our licence server. The application then checks its licence at launch and works offline between two checks, for up to ninety days. A computer is removed from the account or from the application, which frees its place. The data sent is described in the privacy policy.

Refunds and end of a licence

A refunded purchase ends the licences it holds; a refunded upgrade takes the licence back to its previous version. A licence that ended turns the Pro features off and deletes nothing: your mail, and what you made with those features, stay readable and exportable. A licence may be revoked in case of fraud or if its key is published.

Warranties

Consumers benefit from the legal guarantee of conformity of digital content (French Consumer Code, articles L224-25-12 and following). In case of a defect, write to us: we fix it, or refund if a fix is impossible. Beyond these legal guarantees, the application is provided as is; we recommend you do not make it the only copy of important messages.

Liability

To the extent permitted by law, the liability of L'Atelier du Dev for an order is limited to the price paid for that order, except for gross negligence or personal injury. It does not cover interruptions or decisions of email providers.

Disputes and governing law

Write to us first: most difficulties are settled that way. A consumer may then use a consumer mediator free of charge. These terms are governed by French law, without depriving consumers of the protection of the mandatory rules of their country of residence.
